இலங்கை முஸ்லிம் தனியார் சட்டத்தில் பராமரிப்பும் அதன் நடைமுறையும்: கற்பிட்டி காழி நீதிமன்றத்தை மையப்படுத்திய ஆய்வு

Abstract

இலங்கை முஸ்லிம் தனியார் சட்டத்தின் 1951ஆம் ஆண்டின் 13ஆம் இலக்க முஸ்லிம் திருமணம், மண நீக்கச் சட்டத்தின் பிரிவு 47(1) ஆனது மனைவி மற்றும் பிள்ளை அல்லது அதன் சார்பில் கோரப்படும் பராமரிப்பினை பெற்றுக்கொடுக்கும் நியாயாதிக்கத்தினை காழி நீதிமன்றங்களுக்கு வழங்கியுள்ளது. இன்று இக்காழி நீதிமன்றங்களில் பராமரிப்பு தொடர்பில் நடைமுறை ரீதியான பல முறைகேடுகள் இடம்பெறுவதனால் நிவாரணம் கோருவோர் பெரிதும் பாதிக்கப்படுகின்றனர். இந்தவகையில் காழி நீதிமன்றங்களின் பராமரிப்பு நடைமுறைகள் குறித்த ஆய்வு அவசியமாகின்றது. கற்பிட்டி பிரதேசத்தில் இயங்கி வரும் காழி நீதிமன்றத்தின் பராமரிப்பு தொடர்பான சட்டத்தின் நடைமுறையை பரிசீலிப்பதனை இவ்வாய்வு நோக்கமாகக் கொண்டுள்ளது. பண்புரீதியான ஆய்வு முறையிலான இக்கட்டுரை கற்பிட்டி காழி நீதிபதியிடம் பெறப்பட்ட நேர்காணல், 2013 - 2015 வரை பராமரிப்பு தொடர்பாக தீர்க்கப்பட்ட வழக்காய்வுகளின் பகுப்பாய்வு மற்றும் ஆவணங்களின் மீளாய்வு ஆகியவற்றை மையப்படுத்தியது. இவ்வாய்வினூடாக கற்பிட்டி காழி நீதிமன்றத்தின் பராமரிப்புச் சட்ட நடைமுறையில் காணப்படும் ஒருசில முறைகேடுகள் கண்டறியப்பட்டுள்ளன.

Section 47 (1) of the Muslim Marriage and Divorce Act No. 13 of 1951 of the Sri Lanka Muslim Personal Law provides the Quazi Courts with the jurisdiction of granting the maintenance for a spouse or child or claims on behalf of him. In the contemporary context, claimants are greatly affected by the many practical waves of abuse related to maintenance in these courts. This necessitates a study of the maintenance practices of Quazi Courts. Hence, the objective of this study is to examine the implementation of the law relating to the maintenance by the Quazi Court in the Kalpitiya area. Based on the Qualitative research method, the article uses the analysis of data collected through the interview with Quazi of Kalpitiya Qauzi Court, the analysis of cases settled between 2013 - 2015, and the review of necessary documents. The investigation has revealed some irregularities in the maintenance law practice of the Kalpitiya Quazi Court.
